농업부문 미등록 외국인 근로자 고용실태와 과제/엄진영.KREI

농업부문의 외국인 근로자 고용제도인 고용허가제와 계절근로자제는 농가의 일손부족 문제를 일부 해결하고 있으나, 농업 현장에서는 미등록 외국인력(불법체류·불법취업) 고용이 등록 외국인력 고용을 앞서고 있는 현실이다. 그러나 현재 농업부문의 미등록 외국인 근로자 공급 규모와 어떻게 고용되고 있는지에 대한 파악조차 이루어지고 있지 않다. 따라서 이 논문에서는 농가, 지역활동가, 인력소개소 운영자, 전문가를 대상으로 현재 우리나라 농업부문의 미등록 외국인 근로자의 고용 규모와 이들이 어떻게 고용되고 있는지를 양적·질적으로 조사·분석하여, 그 결과를 제시하며, 이를 바탕으로 관련 정책과 제도를 어떻게 개선해 나가야 하는지 시사점을 제시하였다. 작물재배업에서 외국인 근로자를 고용하는 농가 중, 미등록 외국인 근로자를 고용하고 있는 농가는 91.0%이었고, 축산업은 44.2%의 농가가 미등록 외국인 근로자를 고용하였다. 이 논문에서는 미등록 외국인 근로자 문제를 개선하기 위한 방안으로 첫째, 농업노동력 관련 통계 기반 구축, 둘째, 품목별로 미등록 외국인 근로자 고용 원인을 파악과 이에 부합한 제도 개선 방안 마련, 셋째, 조직화·체계화 된 미등록 외국인 근로자의 공급 경로를 제도권으로 움직일 수 있는 방안 마련이 필요함을 제시하였다.

In agricultural fields, unregistered foreign workers who illegally reside in Korea with illegal work status takes a larger portion than registered foreign workers. This paper conducts quantitative and qualitative surveys and analyses on the scale of unregistered foreign workers in the agricultural sector and how they are employed. It presents the results and their implications on how to improve related policies and systems. Then, it suggests measures to improve the problem of unregistered foreign workers. First, it is necessary to establish a statistical basis for the agricultural labor force. Second, it is essential to identify the causes for the employment of unregistered foreign workers and improve the system accordingly. Third, there is a need to prepare a plan to move the organized and systemized supply channels of unregistered foreign workers to the institutional sphere.
